1. Agreement to Terms
By accessing the website and services of platformexecution ("Company"), located at Østerbro 12, 5000 Odense C, Danmark, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Service Description
platformexecution provides IT outsourcing services, specifically dedicated remote engineering teams for technical capacity expansion. Services include but are not limited to backend development, frontend development, DevOps, mobile development, QA, AI/ML integration, CTO advisory, security auditing, and data engineering.
3. Engagement Models
Services are provided under the following models:
- ▸ Dedicated Teams: Monthly engagement with named engineers integrated into your workflow.
- ▸ Project-Based: Fixed-scope delivery with defined milestones and deliverables.
- ▸ Advisory: Fractional CTO and consulting engagements on a monthly retainer.
4. Payment Terms
All pricing is displayed in EUR and exclusive of applicable VAT. Invoices are issued monthly in advance for dedicated team engagements. Payment is due within 14 days of invoice date. Late payments incur a 1.5% monthly interest charge. All payments are processed through our secure payment partner, Stripe.
5. Intellectual Property
All work product created by platformexecution engineers during the engagement is assigned to the client upon full payment. platformexecution retains no rights to custom code, designs, or documentation produced under the service agreement. Pre-existing tools, frameworks, and methodologies remain the property of platformexecution.
6. Confidentiality
Both parties agree to maintain strict confidentiality of proprietary information shared during the engagement. This obligation survives termination of the service agreement for a period of 3 years.
7. Limitation of Liability
platformexecution's total liability shall not exceed the total fees paid by the client in the 12 months preceding the claim. We shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
8. Termination
Either party may terminate the service agreement with 30 days written notice. Immediate termination is permitted in case of material breach that remains uncured for 14 days after written notice. Upon termination, all outstanding invoices become immediately due.
9. Governing Law
These Terms are governed by the laws of Denmark. Any disputes shall be resolved in the courts of Odense, Denmark.
// Refund Policy
Effective Date: January 1, 2026
1. Dedicated Team Engagements
Monthly dedicated team fees are non-refundable once the billing cycle has commenced. If you terminate mid-cycle, the current month's fees remain due. Engineering hours not utilized within the billing period do not roll over.
2. Project-Based Engagements
For fixed-scope projects, payments are structured around agreed milestones:
- ▸ Initial Deposit: Non-refundable upon project initiation.
- ▸ Milestone Payments: Refundable only if the corresponding deliverable has not yet commenced.
- ▸ Completion Payment: Due upon delivery and acceptance of final deliverables.
3. Cancellation by platformexecution
If we are unable to fulfill a service commitment due to circumstances within our control, we will provide a pro-rata refund for any prepaid and unused services, or offer suitable replacement resources at no additional cost.
4. Dispute Resolution
Refund requests must be submitted in writing to [email protected] within 14 days of the invoice date. We will respond to all refund requests within 5 business days. Unresolved disputes shall be subject to the governing law provisions outlined in our Terms of Service.
